Defendant was convicted of murder in the first degree, and the jury not recommending life imprison ment, he was sentenced to death. lie appeals directly to this Court pursuant to R. R. 1:2-1 (c).

The judgment must be reversed and the matter remanded for retrial by reason of Griffin v. State of California, 380 U. S. 609, 85 S. Ct. 1229, 14 L. Ed. 2d 106 (1965).
