ROGERS, Justice.

The State of Louisiana and the Louisiana Highway Commission (now Department of> Highways) brought suit in the Ninth Judicial District Court for the Parish of Rapides against six defendants, three of whom were alleged to be nonresidents of the Parish. Plaintiffs alleged that the defendants had entered into a scheme to defraud and had defrauded the State out of a large sum of money for which they were liable in solido. Richard W.
