INTRODUCTION

The defendant, Crystal Torres (Torres), moves to suppress Torres’s statements she allegedly made to the Gardner police after they stopped the car she was riding in on October 12, 2006.1 The court has allowed the co-defendant, Alexis Rosado-Perez (Rosado-Perez), to join in the motion. Torres claims that police obtained the statements in violation of her state and federal constitutional rights, as she was not given her Miranda warnings before police questioning.
