CONCURRING OPINION

Gilkison, J.

I concur with the results reached in the opinion that the judgment rendered must be reversed. However, I think it is incumbent upon us to decide the many important legal questions directly presented in the appeal. Some of these questions I shall discuss and give authorities supporting my position, which I think should have governed the trial court in the trial and must govern this court in this appeal.
