Anthony Wayne Phillips appeals from the circuit court's order increasing the confinement portion of his split sentence.
On May 21, 1997, Phillips pleaded guilty to burglary in the third degree, a violation of § 13A-7-7, Ala. Code 1975. The circuit court sentenced Phillips, as a habitual offender, to 15 years' imprisonment. Pursuant to the Alabama Split Sentence Act, § 15-18-8, Ala. Code 1975, the circuit court "split" Phillips's sentence into 180 days of confinement and 5 years of probation.
