Appeal by plaintiffs from an order of the district court for Ramsey county, Kelly, J., denying a motion for a new trial.

The plaintiffs brought this action against the defendants, the Merchants National Bank and A. K. Brockelsby, to recover the possession of a negotiable promissory note made by the plaintiffs, and two life insurance policies assigned by them to secure the payment of the note, on the ground that the note and assignment were usurious and void. The defendant bank, by its answer, alleged that it received the note and policies from the United States *38Bank of Hartford, Connecticut, for collection, and disclaimed any other interest in the property.
