This is an action by John W. Preston against the State Industrial Accident Commission, defendant, and J.H. Maden, intervener-defendant. The plaintiff seeks to recover compensation for an injury suffered by him in the course of his employment in hazardous industry, pursuant to the provisions of the Workmen's Compensation Act. The only question involved is whether or not the plaintiff and his employer were subject to the Workmen's Compensation Act at the time of the injury.
