TUTTLE, Circuit Judge:

This is an appeal by the state of Texas from a district court order granting the plaintiffs motion for relief under the Rehabilitation Act of 1973, 29 U.S.C. § 794. The court ordered the University of Texas to procure and compensate a qualified interpreter to assist the plaintiff in his classes during the 1978 term. As part of that order, the court conditioned its grant of preliminary relief on the plaintiff’s filing an administrative complaint with the Department of Health, Education and Welfare (HEW).
