Plaintiffs Nutraceutical Corp. and Sola-ray, Inc., (“Plaintiffs”) brought this action against Defendants Lester Crawford, D.V.M., Acting Commissioner of the United States Food and Drug Administration, the United States Food and Drug Administration (“FDA”), Tommy Thompson, Secretary of the Department of Health and Human Services, the Department of Health and Human Services, and the United States (collectively “Defendants”), challenging the validity of the FDA’s February 2004 regulation banning all ephedrine-alkaloid dietary supplements.
