MEMORANDUM OPINION AND ORDER
ROBERT C. CHAMBERS, Chief Judge.
Pending before the Court are Defendant’s Motion for Summary Judgment *635(ECF No. 33) and Plaintiffs’ Motion for Partial Summary Judgment (ECF No. 35). For the reasons explained below, Defendant’s Motion is DENIED and Plaintiffs’ Motion is GRANTED. The Court FINDS that Defendant is liable under all three Counts of Plaintiffs’ Complaint.
