A. INTRODUCTION
The instant contested matter requires us to consider whether the automatic stay or a stay issued pursuant to 11 U.S.C. § 105(a) should be issued to prevent the United States Department of Labor (“the DOL”) from demanding payment on a letter of credit (“L/C”) issued by the Debtor’s secured lender, National Westminster Bank N.J. (“Westminster”). The L/C in issue was given by the Debtor as security for the Debtor’s participation as a self-insurer in the DOL’s Workmen’s Compensation Program (“the Program”), and the DOL demands payment…
