MORROW, Presiding Judge.

The offense is murder; punishment fixed at confinement in the penitentiary for a period of five years.

The appellant and the deceased, Ford, were negroes. A short time prior to the tragedy, Ford and his wife separated. The appellant claimed that he was unaware of the separation. On the day of the homicide, he went on business to the home of a neighbor of Ford and while there engaged in a conversation with Ford’s wife.
