JONES, Circuit Judge.

The plaintiff, Sierocinski, suffered serious personal injuries through the untimely explosion of a fuse cap of a kind ordinarily used to detonate dynamite charges. He instituted suit for damages against the defendant, the manufacturer of the cap, and obtained a jury’s verdict.
