Plaintiff, The Great Atlantic & Pacific Tea Company, Inc., a Maryland corporation doing business in both the States of Louisiana and Mississippi, filed the above styled action against Hugh B. Cottrell, M.D., the chief health officer for the State of Mississippi, seeking a declaratory judgment voiding Section 11 of the “Regulation Governing the Protection and Sale of Milk and Milk Products” adopted by the Mississippi State Board of Health on December 14, 1967, .and injunctive relief restraining and enjoining the named defendant and his subordinates from excluding plaintiff…
