Defendant Steven James Baudler appeals from a judgment finding him to be an habitual offender in the operation of a motor vehicle pursuant to Iowa Code section 321.555(2) (1983). He contends: (1) that five separate motor vehicle convictions arising out of a single incident and based on the same set of operative facts should not be considered as separate and distinct offenses for the purposes of determining his habitual offender status; and (2) that, when the exceptions under section 321.-555(2) are considered, his driving record did not show six separate and distinct…
