MONTGOMERY, Justice.

This action was instituted in the Pen-dleton Circuit Court as an appeal from, mi order of the county court probating the will of George H. Elliott, deceased. The appellants were contestants below and are the heirs at law of the deceased; and the appellees, who were contestees, are the beneficiaries under the instrument. On the trial in the circuit court, the jury returned a verdict that the instrument was the will of the deceased. This appeal is from the judgment sustaining the will.
