PRENDERGAST, Judge.
On April 20, 1916, the grand jury of Collingsworth County duly indicted appellant for an aggravated assault and battery alleged to have been committed upon H. S. Cook on April 18th. This, of course, included simple assault and battery.
The case was tried at the September term following before the County Court without a jury. Appellant waived a j'ury. He plead not guilty and former jeopardy in that he was convicted of a simple assault for the same offense before a justice of the peace on April 18, 1916, and fined $1 and costs, which he had paid.
