OPINION

ODOM, Judge.

This is an appeal from a conviction for twenty-one counts of theft over $200 wherein punishment was assessed at 10 years and a $400 fine on each count. Appellant’s sole ground of error is a claim of former jeopardy.

On January 13, 1977, appellant pled guilty before a jury to 21 counts of theft over $200. The jury was instructed to find appellant guilty of the offense and to assess his punishment at confinement within a range of not less than two nor more than ten years and a fine of up to $5,000 on each count.
