Appeal by the plaintiff, Anna Callahan, from a judgment of the Supreme Court in favor of the defendant, entered in the office of the clerk of the county of Erie on the 18th day of March, 1918, upon a dismissal of the complaint by direction of the court at the close of plaintiff’s case.

Hubbs, J.:

In March, 1914, William J. Leggart, deceased, made an application for membership in Nickle Plate Lodge No. 220, a subordinate lodge existing under and created by the Grand Lodge of the Switchmen’s Union of North America, the defendant herein. On April twentieth of the same year the defendant issued to the decedent a beneficiary certificate in which it was provided:

“ That in consideration of all dues and assessments paid and to be paid in accordance with the provisions of tfie laws, rules and regulations of the beneficiary department of the Switchmen’s Union of North America by…
