The defendant-appellant was tried and convicted September 29, 1964, in the superior court for Grand Rapids, before a jury, of the offense that he did “unlawfully and feloniously assault a child under the age of 16 years, to-wit: [A] 1 of the age of 10 years, and did attempt to take indecent and improper liberties with the person of said child.” 2 On the afternoon of June 27, 1964, the defendant’s daughter, [B], 1 of about 10 years of age, and a friend of A’s asked A to stay at B’s home that night.
