The appellee exhibited an original bill in the court below against the appellant to recover the value of certain tim-*377her cut anti removed by the appellant from the east half of section 16, township 6, range 14 west, in Hancock county. The cause was heard on bill, answer, and proof, and a decree was rendered in accordance with the prayer of the bill. The facts are practically undisputed, and are in substance as follows:
