Judgment unanimously modified on the law and as modified affirmed in accordance with the following Memorandum: Defendant appeals from a judgment convicting him of two counts of murder in the second degree (Penal Law § 125.25 [1], [3]) and one count each of robbery in the first degree (Penal Law § 160.15 [1]) and criminal possession of a weapon in the second degree (Penal Law former § 265.03). He was sentenced to an aggregate term of incarceration of 33 Vs years to life.
