MEMORANDUM OPINION

This adversary proceeding came before the Court on the Complaint to Deny Dis-chargeability of Debt 1 filed by the Plaintiff Avis Rent A Car Systems, Inc. (“Plaintiff’ or “Avis”) against Earl David Maxwell, the Defendant and a Debtor herein (“Debtor”). This is an action to determine the dis-chargeability of a debt pursuant to 11 U.S.C. §§ 523(a)(2)(A) and 523(a)(6). A trial was held on September 27, 2005.
