Appeal from a judgment of the superior court for Stevens county, Richardson, J., entered April 13, 1903, upon the verdict of a jury rendered in favor of the plaintiffs, after a trial on the merits, for $2,000 damages to premises, caused by fumes from a smelter.

Respondents are the owners of certain lands situate near Horthport, in Stevens county, Washington, and appellant is the owner and operator of a smelter located at Horthport. Respondents brought this suit against appellant and alleged, that, at all times continuously within two years last past, the appellant corporation has maintained and operated its said smelter plant; that, in connection therewith, it has caused sulphide ores to be roasted in heaps, and has smelted about one thousand tons of ore daily during said period; that the ore so smelted contained about ten per cent of sulphur, and…
