MEMORANDUM OPINION AND ORDER

RUBEN CASTILLO, District Judge.

On December 9, 2008, a Grand Jury returned a superseding indictment charging Hanjuan Jin (“Defendant” or “Jin”) with three counts of theft of trade secrets and three counts of economic espionage in violation of the Economic Espionage Act, 18 U.S.C. § 1831 et seq. (“EEA”). (R. 37, Superseding Indictment.)
