This is a Wunderlich Act (41 U.S.C. §§ 321-22 (1964)) review case that comes before the court on the parties’ cross motions for summary judgment. The decision below is ASBCA Nos. 13812 and 13865,70-1BCA § 8318. Jurisdiction is conferred by 28 T7.S.C. § 1491. Commissioner William E. *100Day, by order of the court under Kule 166(c), has reviewed the record and submitted a recommended opinion. We reach the same result as he by a somewhat different route, but have used large parts of his text and acknowledge the able assistance he has rendered.
