This is an action in equity arising out of the fact that a mother conveyed land to two sons on their agreement that on her death they would pay the purchase price in equal shares to her ten children. One son carried out his part of the agreement-, and suit was brought against the other son and his wife, who are the only defendants. *214In legal terminology, it is an action by third party donee beneficiaries against the promisor to recover upon his promise made to the promisee for the benefit of said third party beneficiaries. -The court found for plaintiffs and entered judgment against…
