Upon a plea of guilty Donald E. Schulz was convicted of second offense driving while intoxicated and was later sentenced to probation for a period of 1 year. Among the terms and conditions of the probation were that his operator’s license be suspended for 6 months and that he serve 48 hours in the county jail, abstain from the use of alcoholic beverages, and submit to chemical tests at the request of the probation officer. Five months later, that probation was revoked by the county court as a result of Schulz’ refusal to submit to a chemical test requested by his probation officer. By this…
