Timothy W. Anderson, a resident-taxpayer of Phelps County, brought suit against Willard Peterson, Alfred Holthus, Earl Thorell, Marvin Dannehl, Clarence L. Larsen, Erwin Braner, and Melvin Sail as members of the county board of Phelps County. Anderson alleged that the board members, without competitive bidding required by Neb. Rev. Stat. § 23-324.05 (Reissue 1983), entered a contract on behalf of the county to replace the existing heating and air-conditioning system of the Phelps County Courthouse for $200,213.
