This case has a lengthy and complicated procedural history, but the narrow issue on appeal is whether the district court correctly found that Harris still has an unexhaust-ed right to post-conviction relief in the Illinois state courts. Harris was convicted of armed robbery and aggravated kidnapping on October 27, 1966. He did not perfect a direct appeal, apparently because the notice of appeal was never properly filed.
