This is a suit in equity, commenced August 18, 1926, for partition of the land described in grant number 2122, situate in the district of Hamakua, County of Hawaii, and containing an area of 120 acres. Issues were raised concerning the title to the land and these were heard and decided by the presiding judge without a jury. His conclusion was that the petitioners had no title and that the title was vested seven-eighths in the respondent and one- . eighth in one Charles H. Baker, as tenants in common.
