I. INTRODUCTION

This action was originally filed on July 23, 1976, as a class action by eleven West*927ern Pennsylvania coal haulers against the Defendants United Mine Workers of America [UMWA], District 2 of the United Mine Workers of America, and Local 1600 of the United Mine Workers of America [hereinafter collectively referred to as “Defendant” or “Defendant Union”].
