This is an appeal or in the alternative a petition for writ of mandamus.

The matter first began in the Circuit Court of Marshall County, Alabama, with the filing by John Byron Moore of a petition for hearing, under Title 36, Section 68, Code of Alabama (1940), of the suspension of his Alabama driver’s license by the Director of Public Safety of the State of Alabama. The petition stated that the revocation was made by the Director on October 14, 1972, for a conviction of driving while intoxicated.
