I. INTRODUCTION

This matter comes before the Court on Plaintiff Canal Insurance Company’s Motion for Summary Judgment. Dkt. #26. The underlying lawsuit giving rise to this action involves a 2008 collision between a tractor-trailer and a passenger vehicle.
