The plaintiff in error brought suit in the superior court of Fulton county against J. H. Gaissert as executor of the will of Zach Martin, Stephen B. Martin, and J. J. Woodside, making substantially the following allegations: Gaissert is a resident of Morgan corahy, Woodside is a resident of Fulton county, and Stephen B. Martin is a non-resident of the State.
