Plaintiffs appeal from an order granting defendant’s motion for summary judgment entered in the Kent County Circuit Court on April 22, 1980. The motion was brought by defendant pursuant to GCR 1963, 117.2(1) and (3). It appears from the order entered that the judgment was granted under GCR 117.2(1), the court finding that plaintiffs had failed to state a claim upon which relief could be granted.
