The State appeals the dismissal of misdemeanor charges against the defendant, Robert Bain, Jr., by the Littleton District Court (Cyr, J.). We reverse and remand.

The following facts are either supported by the record or undisputed by the parties. On October 23, 1998, the defendant was arraigned in Littleton District Court on misdemeanor charges of simple assault and criminal threatening. See RSA 631:2-a, 1(a) (1996), :4, 1(d) (Supp. 1999).
