The plaintiff, Ruszcyk, a former municipal police officer who was injured while participating in training at the Massachusetts State Police Academy, Framingham, appeals from a judgment on a jury verdict in favor of the Com*419monwealth in his action brought in the Superior Court under G. L. c. 258 (Massachusetts Tort Claims Act). We transferred the appeal to this court on our own motion.
