Mr. PRESIDING JUSTICE CARTER

delivered the opinion of the court:

Mark Finley, defendant, seeks review of a conviction by a jury of obstructing a peace officer and the sentence of 60 days imprisonment and *250 fine imposed thereon.

Defendant contends the court erred in submitting the case to the jury and in giving certain instructions. He also claims that the trial court improperly conducted the hearing in aggravation and mitigation. The defendant’s final contention is that the court shogld have granted him probation.
