Plaintiff originally instituted this action against the New York Life Insurance Company to recover the proceeds of a policy it had issued upon the life of her son, and in which she was designated as the beneficiary. The widow of the insured having asserted a claim to the proceeds at about the same time, the insurance company paid into the registry of the court the face amount of the policy less the amount of certain unpaid loans against it.
