A brief preliminary statement of the transactions out of which this suit arose will aid in understanding the issues involved.

T. H. Weempe, joined by his wife, Mrs. Sallie L. Weempe (now Mrs. Sallie L. Powell and appellant herein), on June 7, 1930, entered into a written contract with Jones Building Corporation, hereinafter called Building Corporation, for the purchase of the house and lot involved herein.
