The sole issue in this case is whether the appellant, Robert Burrell, was denied his right to ajury trial in a felony non-support case. We hold that he was denied his right to ajury trial, and we therefore reverse and remand the case for a new trial.
At appellant’s arraignment on April 22, 2003, his counsel waived the reading of the information and entered a plea of not guilty on his behalf; however, there was no mention of whether the case would be tried by a jury or to the bench.
