MEMORANDUM OF DECISION

Before the Court is the debtor’s “Motion to Approve Pre-Confirmation First Amended Chapter 13 Plan” (the “Motion to Amend”), to which William Dubinsky & Sons, Inc. (“Dubinsky” 1 ), a creditor, has objected. Also before the Court is Dubin-sk/s “Motion for Approval of Super Priority Claim” (the “Motion for Superpriority Claim”). The issue is the same.
