Plaintiff CytoSport, Inc. (“plaintiff’ or “CS”) brings this action against Vital Pharmaceuticals, Inc. (“defendant” or ‘VPX”) for trademark and trade dress infringement, unfair competition and false advertising under federal and state law. (Second Am. Compl., filed Mar. 19, 2009.)
