In this case, after giving notice of his intention to testify before the Grand Jury, the defendant failed to appear in criminal court as required and a bench warrant was issued for his arrest. Three weeks later, without the knowledge of his attorney or the prosecutor assigned to the case, the defendant reappeared before the court and the warrant was vacated. That same day, without making any attempt to notify the defendant or his attorney, the prosecutor asked the Grand Jury to consider charges against the defendant, and the Grand Jury voted to indict him.…
