Almand, Presiding Justice.
Under an indictment charging him with murder for unlawfully and with malice aforethought killing one Joe C. Tolbert by shooting him with a pistol, Elijah Grice was upon his trial found guilty by the jury and sentenced to death by electrocution. The defendant’s motion for a new trial was overruled, and he appeals from the judgment of conviction and sentence.
