Harold Birkeland, hereinafter referred to as plaintiff, presented a petition to the governor charging the county attorney of Hennepin county with acts and omissions claimed to constitute malfeasance and non-feasance in the performance of official duties. He petitioned for the removal of the county attorney from office. He ob tained from the district court of Hennepin county an alternative writ of mandamus, which came on for hearing before the district court of Ramsey county.
