I.INTRODUCTION

Citibank, N.A. (“Citibank”) filed a complaint in the Circuit Court of the Twentieth Judicial Circuit, in and for Lee County, Florida, for mortgage foreclosure based on payment default and to reestablish a lost note. 1 In response to the foreclosure complaint, Christopher Dalessio (“Dalessio”) filed an answer, affirmative defenses, and counterclaims against Citibank and a third-party complaint against American Home Mortgage Servicing, Inc.
