SINGLETON, District Judge.

INTRODUCTION

Before the Court is Plaintiff Allstate Insurance Companies (“Allstate”) motion for summary judgment. See Docket Nos. 19 (Mot.); 49 (Opp’n); 69 (Reply). Also ripe for a ruling is Defendant Charles Herron’s motion to compel. See Docket Nos. 70 (Mot.); 75 (Opp’n); 78 (Reply). As the Court outlined in its July 13, 2005, order denying Herron’s motion to decline jurisdiction in light of related state proceedings, Allstate sues Herron for a declaratory judgment that it did not breach its insurance contract with him.
