Plaintiff in error filed his suit in Kingfisher county against defendant in error, board of county commissioners of Kingfisher county, to recover an attorney fee and expenses. For convenience, the parties wall be referred to as they appeared in the trial court.

Plaintiff alleged that on October 21, 1927, the board of county commissioners of Kingfisher county presented an accusation for removal from office against R. F.
